Recovering delinquent debt drains resources, and the recovery process often fails. With the time, money and manpower spent on debt collection, many businesses find it more appealing to hand off delinquent accounts to a debt collection agency rather than face the negative impact on the company.

However, any company can increase their return on investment with a little effort and skill. Boosting in-house debt collection is an art, but with driven people and knowledge of tricks of the trade, any business can see greater results.

One of the most important things to do is to start the debt collection process early. Rather than waiting until the debt is delinquent, call the debtor as a reminder to pay the bill on time. This can significantly decrease the number of delinquent debt portfolios the business must deal with.

Also, waiting until the debt is old is a mistake. The sooner the debtor is contacted after the payment becomes delinquent, the more likely a business is to recover the sum. Starting the call process within the first ten days is essential. The most effective means of recovery is to first call the debtor as a reminder and to let them know they will receive a letter in the mail. Then, immediately send the written request for payment.

Courtesy at the beginning of the debt collection process can go a long way. However, if this doesn’t work in the short term, it certainly won’t work in the long term. The longer it’s been the more adamant the debt collector should be insisting the debt is recovered immediately. A definitive consequence of nonpayment can eliminate the possibility of the debtor ignoring the calls.

One way to increase the bottom line is to pursue smaller debts first. These are more easily recovered because it is more likely a debtor can pay the smaller sum immediately. Debt collection is a more difficult task with larger sums, since these are often harder to gather and sometimes require working out a payment plan.

Cut off credit lines. For those in the debt collection process, it is necessary to restrict purchases to advanced payment options, meaning they are no longer extended credit by the company. Extending credit to clients with delinquent payments does not motivate them to pay the outstanding sum, nor does it drive home the insistence that all bills be paid on time in the future. If a debtor is unable to purchase needed supplies or services, they are more likely to find a way to pay the amount due.

With some determination and logic, a lot of time and money can be saved in the debt collection process while increasing the amount recovered in the pursuit. Being sure to stand firm in the resolve to reclaim lost money is essential to the success of the endeavor.

When it comes to trying to recover unpaid accounts from your debtors, the myriad of debt collection laws can sometimes feel as though they’re getting in the way. Obviously your main goal is to try and encourage as many late-paying account holders as possible to pay their debts and help keep your business’ cash flow strong.

Communicating With Your Customers – Do you know the guidelines and rules when it comes to communicating with your late-paying customers? The Fair Debt Collection Practices Act protects and regulates the kinds of communications allowed between creditors and debtors.

For example, there are limitations placed on the times during the day, as well as weekend, when you can contact debtors. There are also limits governing where you can and cannot contact delinquent customers about their past due accounts. Make sure you understand and operate within these legal prescriptions.

When contacting a third party to try and reach the debtor, you’re also restricted in only asking the third party for information about reaching the actual debtor.

Ownership Of Debt Disputes – There may be instances when a debtor will deny owning the debt, or that they owe your business any money. When this occurs, you are required to send written proof of this outstanding debt

Accurate and Truthful Information – It is imperative that you provide your debtor with accurate information. For instance, it is against the law for you to threaten or insinuate that you’ll have debtors arrested. You also can’t falsely represent that you have legal representation, when in fact, you do not. Nor can you imply that you have some governmental entity chasing after them.

You’re only able to give real information about the debt and your collection methods must abide by the debt collection agency laws at all times. Did you know that for violating the debt collection laws, your debtors could sue you for violation and potentially collect as much as 1 percent of the collector’s net worth.

It is very important that your business clearly understand the debt collection laws as related to your collection methods. Collection agency laws extend beyond simply getting customers to pay their delinquent debts.

You may also need to learn how the changes to the Fair Debt Collection Act may relate to customer access to credit reporting information. They may wish to verify the information listed on their credit report, so you need to be sure the information you provide is always accurate. Business owners that don’t adhere to these laws may face some steep fines and they may even find that the debt owed to them could be discharged.

Sometimes debt collection can be a difficult process, but as long as you understand the debt collection laws or the collection agency laws and how they can affect which actions you need to take to recoup money owed to you then you may find it’s not as difficult as it sounds.

Knowing what legal actions you can take can also help you with creating and building successful debt collection strategies, wherein you are able to properly communicate with your debtor and recover the debts owed to you.

Montana has been a distinguished enterprise coach, business consultant in addition to publisher when it comes to collection agency options for thirty years.

The Fair Debt Collection Practices Act, FDCPA, is a federal law that governs the actions of debt collectors for personal debts. When a third-party used to collect a debt, that third-party is obligated to follow the FDCPA. The FDCPA does not regulated business debt or personal debt incurred for the benefit of a business.

The Fair Debt Collection Practices Act prohibit Debt collectors from making harassing, threatening, or misleading statements in order to trick you into making payments. The FDCPA provides that as long as the debt collector knows that you are represented by an attorney, the debt collector cannot contact you directly. The act provide many other safe guards to protect the consumer. The entire should be read because there are many other proctections that the FDCPA provide.

Debt collectors who violates the FDCPA should be reported to the nearest office of the Federal Trade Commission. Also, an aggrieved party can file a federal or state lawsuit against the debt collector for violation of the law. However, usually you have to file the lawsuit within 1 year of the violation to recover the actual damages. One can also recover up to a $1,000 in an individual lawsuit or $5,000 in a class-action lawsuit for each violation, plus attorney fees and costs.

Debt collectors use many different strategies to force you pay them before pay any other debt, even if its not in your best interest. Despite the pressure you might receive never agree to pay a debt collector if you need to pay other, more important debts first.

If you feel a debt collector has used techniques such as harassment, abuse, and misrepresentation, you should consider contacting an attorney. Most attorneys will provide a free and confidential consultation. They will help you understand your options and give you unbiased advice.

If your business is handling its own debt collection methods internally, then you already know the need to send out demand letters to non-paying clients that arise from time to time.

If your business is handling its own debt collection methods internally, then you already know the need to send out demand letters to non-paying clients that arise from time to time.

Many business owners would rather use the “gentle” approach by first sending a friendly reminder. The idea is this may serve to help “jog” the customer’s memory of the past due bill.

These are often effective, but they can be improved by learning some tips to help you write a better demand letter. This can help make customers want to pay you sooner, as opposed to later.

1. Careful Professional Wording

Your demand letter should never contain any kind of threatening language or terms that can imply threats. People can become very defensive if they feel they are being attacked, whether it’s rightful or not. This defensiveness can often become retaliation and prompt them to become even more stubborn about not paying your unpaid bills.

Your demand or collection letters should stay on point, and clearly communicate that the customer owes an unpaid debt, and encourage them to pay. This is often incentive enough to get your customer to pay.

2. Be Accurate

Demand letters should clearly state the exact amount that is late and past due, as well as when payment was due. It can be good to also remind them of the products or services originally purchased. These letters should be succinct and brief.

3. Payment Plan

Some customers may avoid all contact with you, possibly out of embarrassment to admit they’re going through financial straits. A payment plan offered to them might be more financially feasible, with smaller payments.

They could become more cooperative after being offered payment arrangements, because smaller payments are less financially stressful.

4. Late Fees

Mentioning the possibility of late fees or penalties might be a further incentive for some customers to pay. Your demand letters could mention tacking on additional late fees if the account continues to remain delinquent. Faced with the possibilities of still more fees, some customers will find the money needed to pay the debt.

These suggestions can increase the cash flow to your business, by receiving smaller payments over a period of time. They will also encourage your late-paying customers to pay their past due accounts.

If you’re dealing with your debt collection procedures in-house and writing your demand letters yourself, you must not imply that a debt collection agency is involved in the collecting.

You should also be careful not to use wording that can imply a threat of any form, nor can you use any form of deception in your letters. This means you may not imply that the customer could be facing legal action or that you’re working with a government department to recover debt. You’re also not allowed to imply the threat of garnishing a customer’s wages to recover debt.

It’s also a violation of federal statutes to try to make your demand letter look like it’s been written and sent by a state or federal agency or from a court.

Use a professional tone in your writing, using your own regular business stationary. Generally, you should send two demand letters, spaced about 30 days apart. If these aren’t proving to be successful, perhaps it may be time to think of alternative debt collection methods, including hiring outside collection agencies to help you with your collections.

Does your small business have rising unpaid invoices? Do you not have adequate staff to make collection calls? It may be time to hire a debt collection agency. For a very affordable fee, they can collect your bad debts and bolster your finances.

Does your small business have rising unpaid invoices? Do you not have adequate staff to make collection calls? It may be time to hire a debt collection agency. For a very affordable fee, they can collect your bad debts and bolster your finances.

Small and home-based businesses have to face the daunting task of collecting outstanding bills during their course of existence dealing with bad debts. Whether an uncollected bill is the outcome of genuine shortage of funds at the client’s end or her being a customary defaulter, overdue amounts need to be collected on priority to avoid loss to business. Business heads should have a realistic action plan to manage this problem effectively. Collection agencies are a good option for small and home businesses without the necessary bandwidth and resources to collect outstanding invoices proficiently.

While an occasional unpaid debt can be absorbed in the business expenses, a number of such unpaid invoices take a toll on the cash flow. If the total cost of the bad debts is substantial enough to justify the cost of hiring a collection agency, it is your best shot at getting your money from delinquent clients.

Strategies for hiring a collection agency

A debt collection agency will be dealing with your customers and it should respect your policies and customer service values. As far as clients are concerned, the collection agency is an extension of your business and their experience with the agency will impact your customer relationships. Therefore, you should evaluate a few significant points while deciding on a collection agency, such as:

* Experience working for similar business size and type: Shop around for a collection agency that has some experience with small and home-owned businesses and how they operate.

* Experience with collecting from similar businesses: A collection agency that has handled customers often seen by businesses of your type and size has a better shot at succeeding. Individual non-payers and corporate debtors are very unique and need dedicated handling.

* Skip tracing: Many times, clients move without leaving a forwarding address or get their phone lines disconnected. Collection agencies include specialized skip tracing services – accessing multiple databases – to pin down the whereabouts of debtors and remind them of the unpaid invoice.

* Kind of collection strategies: Verify the collection agency’s collection strategies. If the agency has achieved reasonable success by sending out letters to defaulters, appraise the correspondence yourself to make sure the content complies with the Fair Debt Collection Practices Act. In doing so, you safeguard your customer relationships. Respectfully yet strongly scripted communication can get clients to make their payments and also go on doing business with you.

* Errors and omission insurance: Collection agencies and hiring businesses are insured from liability by the Errors and Omission insurance if displeased non-payers file a suit against the strategies employed to collect the debt.

* Licensing issues: The collection agency should have the legal right to collect debts in locations occupied by the debtors. Otherwise, the collection agency and your business can be charged for unlawful debt collection without a license.

* Collection agency rates: Collection agencies charge fixed fees or contingency rates. The contingency rate is a fraction of the total unpaid sum collected. It is recommended that you do some math with the collection agency’s success rate and contingency rate before finalizing the pricing option. Calculate the charges in both cases – fixed versus contingency, and select the one that works best for you.

Bad debts weigh down every business but they can endanger the existence of small and home businesses that do not have the necessary resources to protect them when strapped for cash. Collection agencies are a sensible choice as even after deducting their fees, you end up getting more than what you would if you pursued the debtors yourself.

Even though the economy is suffering, and many of you are in debt, there is no reason that you cannot throw a really great Super Bowl Party.

Even though the economy is suffering, and many of you are in debt, there is no reason that you cannot throw a really great Super Bowl Party.

Focus on not overdoing it. Make just one extravagant dish and play the rest off of that. A vat of chili, if seasoned correctly can serve twelve people for twenty dollars. Chicken wings are very inexpensive and easy to make. Coils of kielbasa, priced around five bucks are a cheap and delicious snack.

Because the Super Bowl is a special occasion, opt for hot food. Ordering large trays of Chinese takeout are less expensive and time consuming than cooking your own food.

Children at Superbowl parties can be tough to please. Vegetables, juice, chips, and a carvel football shaped ice cream cake priced at $22.99 will keep them at bay.

Drinks? The best choice for shoppers on a budget is beer and wine. A keg will save you about 40% according to experts. The wine doesn’t have to be fancy – a five liter boxed wine will be more than acceptable. If you encounter the troublesome guest who insists on liquor, get discount vodka, a half gallon for just fourteen dollars. Its cheap, and blends with about anything.

Even in tough times, it is neccessary to make the most of your game-viewing experience. A medium to large flatscreen is completely necessary. But if you don’t own one, rent one. Websites list 42 inch TVs for as low as $26.99 a week.

And then those irritating people who won’t watch football. A pool for small gifts like a store certificate or CD might inspire people who aren’t the least bit interested in football at all if a prize is awarded at the end of every quarter. Try to have experienced fans explain what is going on. Then, sit back, and enjoy your game.

It seems as though record companies have developed a new game plan in order to collect royalties. As we all know, the music industry attempted to sue individual users who illegally downloaded songs. But because of this approach to recover from major fiscal loss has destroyed their public image.

Instead of lowering the cost of CDs in order to compete with music circulating through the internet that is for free, these businesses have turned to collection agencies who are now bringing cellphone companies to court over royalties from ring tones. Contesting that ring tones counted as public performances, the music industry asserted that cell phone companies should be obligated to pay performance fees. The courts quickly denied this claim.

Despite this unfruitful endeavour to collect on royalties, Broadcast Music Inc is now suing T-Mobile over ring back tones, alleging that the mobile carrier is selling them without licensing agreements. Unlike ring tones, which play publically when someone calls, ring back tones are only heard specifically by the person calling. Instead of hearing a cellphone dialing, the caller will hear a song that was chosen by the cell owner.

Critics are quick to point out the apparent irony of this lawsuit. If ringtones, which can be heard by anyone around a cellphone, do not constitute public performance, it seems ludicrous to sue the mobile carriers over a ringback tone that can be heard only by the caller. With record companies suffering from huge financial losses, it seems as though they are grasping at straws in order to collect any money that they possibly can.

It does not appear that lowering the cost of CDs, DVDs and other media is an plan that has occurred to the music industry. There are still quite a few fans out there that prefer to collect and own the actual products, but with prices constantly spiking, downloading music for free seems very appealing. Many CDs generally go on sale for about seventeen dollars.

Specific bands have been skirting the issue of music downloading through unique tactics. Radiohead, an alternative rock band, established a website where fans can download the music for free, or for a donation. Nine Inch Nails’ Trent Reznor has followed suit. With record companies’ unsuccessful lawsuits and declining public image, it seems as though thinking outside of the box and fair pricing may be more effective than bullying money out of mobile carriers and individual users.
